Apparently I don't read your main blog closely enough, as I didn't notice your follow-up article regarding the Jones case. I was Googling it today and saw the National Law Journal article analyzing the Supreme Courts refusal to hear the case. It looks like it was a close call, with an interesting alliance of justices in favor of hearing the case. Too bad it didn't actually make it to the Supreme Court - it seems like an important issue.
