Pew Center report brings attention to state punishment rates in Ohio and nationwide
Though we likely won't formally transition to non-capital sentencing topics until next week (or maybe even the week after), I wanted to start that transition on the blog by highlighting a new report from the Pew Center on the States, titled "One in 31: The Long Reach of America Corrections." The full report -- which provide an effective "gold-standard" model for what a great final paper might look like -- is available at this link. The Columbus Dispatch provides a local spin on the report with this article, headlined "Punished population soars in Ohio, U.S." Here is the start of the Dispatch article:
One in every 25 adult Ohioans is in prison, jail or on parole or probation, a study by the Pew Center on the States shows. While the national average is one in 31 U.S. adults, the numbers are more dramatic for Latinos (one in 27), men (one in 18), and blacks (one in 11), according to One in 31: The Long Reach of American Corrections, released yesterday.
Ohio's one-in-25 rate was sixth among the states. Georgia had the highest at one in 13, and New Hampshire the lowest at one in 88.
The first-of-a-kind study showed a huge jump in the corrections rate since 1984, when it was one in 77 Americans. Nationally, there were 7.3 million people in prison, jail, on parole or on probation in 2007. Of those, 351,879 were in Ohio -- about 50,000 in state prisons, with the vast majority in community corrections facilities, on parole or on probation.
At a time when states are facing the worst financial crunch in decades, spending on corrections continues to be one of the fastest-growing pieces of state budgets, second only to Medicaid in the past two decades, the Pew Center concluded. The national cost to taxpayers for all forms of corrections is $68 billion annually. The study said $1 out of every $15 in discretionary state spending goes to prisons.
The Dispatch also has this webpage seeking reader input, titled "The Hot Issue: Would you rather see Ohio build more prisons or put more offenders on probation?". As of this writing, the on-line voting is very close (but on-line voter "turn-out" is low).

DB is in the middle of the most honest, inspiring lecture I have heard in my three years of law school.
The two times we meet each week are the best workouts my brain has had since the first time someone told me how babies are made.

DB just censored and deleted valid methodological criticism of this biased, misleading pro-criminal, anti-crime victim study, basically garbage science propaganda for the lawyer client. What are we here, children?

I live in a lawyer residential neighborhood. The same effect is true here. The police show up, college educated, three cars at a time, in less than 2 minutes, blasting. No armed criminal makes it out alive. No excessive force litigation here.

Man, get over yourself. You are a grown man using the name Supremacy Claus (I guess an attempt at some sort of Santa Claus humor) to anonymously post on a law school class blog. At least have the stones to use your real name if you are going to constantly take shots at someone.
DB spends his time creating 3-4 blogs, trying to get his students to actually think about the world they live in and you just sign on with your ingenius blog name and criticize everything he does.
Instead, why don't you start your own blog, using you real name and be as open and honest with your viewpoints as the guy you are constantly criticizing.

I have heard from several friends that Atlanta and Savannah are great places to meet women. Now I think I understand why--Georgia has the highest incarceration rate.

I apologize to DB. I may have deleted my critique myself to avoid seeming relentless in one day. I will post it again.
I admire his courage. He can block me anytime. I think he likes the different. And I try to maintain a level of novelty. I have had legal training, and be a total whore, and rebut myself with stuff you have never heard before. However, the critical is healthier because every goal of every law subject is in utter failure, except for rent seeking. So this little academic discussion, this let's have fun at midnight in the college dorm debate? It generates $10 mil a pop for appeals for the most vicious butchers among us. None used anesthesia nor considered the Eighth Amendment when slitting the throats of little girls to enhance their sexual pleasures. The lawyer allows 23 million crimes, 5 million being violent. Sentencing guidelines dropped the number by 40%, but were repealed by Scalia and his gang. And now, we have the Scalia Bounce in murder rate.
The vile, criminal lover lawyer hierarchy, in its rent seeking is responsible for this mass murder with scienter crime against humanity. Does DB want the real story on the death penalty or to go on with his ridiculous left wing bias, immunizing and protecting the lawyer clients?
Lawyer test. If you passed 1L, you cannot utter the V word. It sticks in your craw, makes you gag and choke. Say it out loud. You can't. Victim. No one here can. This test has been party validated. No lawyer has gotten it out, even if drunk.

1) Nearly total criminal immunity from the lawyer. List the crimes in your criminal law hornbook. Of all those that are committed, how many are reported? Let's be generous, about 1 in 10. Of the reported ones, how many are investigated by the police and brought to prosecution? About 1 in 10. Of those prosecuted and convicted, how many go to prison? Say, again 1 in 10. So each of the above incarcerations stands in for 1000 crimes committed. OK what about murder, where two thirds of cases are closed? There are 100,000 people missing a year, without resolution a year. If I were to murder someone, I would clean up my mess, and bury the victim somewhere. How do you know the 17,000 recorded murders are not 117,000 murders a year? You don't. There is some chance the person with a minimum of care gets away with murder 90% of the time. The lawyer has immunized 999 of 1000 crimes. Why? The lawyer does not want his client in any way upset. One may not even verbally abuse a criminal without risking ruinous litigation.
2) Racism. The unspoken correlate of the statistics is the strong correlation with race, around 0.6, a fairly strong one for a study that covered up the data. This is a racist implication if not accompanied by a dsiclaimer and explanation. You may find many available females in Georgia, but most will be black, because their guys are in stir. There is no difference in the rate of antisocial personality disorder in blacks. Blacks have slightly lower rates of drug abuse and alcoholism probably because of lower wealth. So it has to be explained. a) the police does not protect black folks, so the criminals feel they have open season; b) bastardy strongly correlates with criminality, and the lawyer destroyed the black family in the 1960's, after its surviving slavery, wars, lynchings, poverty, it could not survive the assault of the vile lawyer hierarchy. So whites do not feel smug, the lawyer has inserted an ice pick into the heart of the white family in the 1990's, it is merely slowly bleeding to death and dead, without knowing it. White bastardy will catch up, and so will white crime rates.
3) Sentencing guidelines. The outrage of the public at the Fallujah like conditions in urban areas led to sentencing guidelines to restrain the criminal lover, rent seeking criminal cult hierarchy sitting on the bench. Within a couple of years, they dropped victimization rates by 40%. Not bad. But that means, lawyers lost jobs as well. So Scalia led a series of 5 cases to take out all sentencing guidelines, including state guidelines. Now, we are enjoying the Scalia Bounce in the murder rate in many cities. As the effect of these decisions percolates over the next 5 years, Fallujah is back. No mention of guidelines in this garbage science, misleading, criminal lover left wing propaganda tract.
I will stop here, to avoid piling it on. The Pew Foundation is a notorious, America Hater, Commie front organization. I know some of its high officials, its being local. I now know it is also a racist organization. David Duke would find this report quite useful.
I am willing to debate DB anytime, anywhere. What the lawyer does is a crime against humanity, with the scienter of 50 years of experience, never changing experience. The KKK was a lawyer and judge founded operation that lynched 5000 people. The lawyer represented here is herding crime and murder into black folks neighborhoods, has caused an excess of black murder victimization that is nearly two orders of magnitude larger than that. And how can you get away killing 5000 wealthy successful people, and taking their titled property? The lawyer propaganda has these lynchings as done to black kids who wolf whistled a white trash hussy. That is a lie. They went after moneyed business people, professionals, and others with property earned without affirmative action. And took it. How you do that?
Grant had the remedy, hanging 100's of KKK'ers, including many lawyers and judges. I would like to see Reconstruction II, where the entire lawyer hierarchy gets arrested for insurrection against the Constitution, tried in a show trial for an hour, where they are forced to wear tall dunce caps, where the sole evidence is excerpts from their appellate decisions, and not any collateral corruption. Then, they hang immediately from the courthouse trees, right outside.

Supremacy, your consistently poor grammar (see e.g. "The lawyer propaganda has these lynchings as done to black kids who wolf whistled a white trash hussy.") and desire to see the "lawyer hierarchy hang from the courthouse trees" really put a damper on the sunshine of this blog.
I have a feeling Prof. Berman will tell our class to ignore your posts the next time our class meets, but until then I'm just curious what exactly is your agenda? Are you in favor of harsher punishments? Do you dislike only defense attorneys? Prosecutors? The human race?
And I agree that criticism is healthy, when done in an educational, informative manner. However, posting that lawyers should be hanged, likening the legal profession to the KKK and describing how easy it would be for you to dispose of a dead body do not seem to further any type of stimulating, intellectual debate.

Andrew: Protecting the public is a core aim of government. The criminal law is in failure because its only real goal is the rent, and not the self-stated protection of the public. The Supremacy hates no one, loves everyone. It expects people to start doing their jobs and to stop misleading the students and the public with biased, left wing propaganda.
Lynchings were an example of lawyer immunization of mass, genocidal murder. It's a good idea to not face that historical fact. Do not face the fact that lawyer forbearance of the murder of young black males resulted in murder victimizations nearly two orders of magnitude larger than the entire series of lynchings. There are no $10 mils spent on lawyer fees for appeals before the murder of victims, nor any use of anesthesia before victims are butchered by the lawyer customer, to stay within the bounds of the Eighth Amendment. Not only is that mass murder with scienter of no concern to you, but you cannot even write the word, victim. I have given up on getting you to say it out loud. Do not discuss the excess of 300,000 murders of blacks, over the past 50 years. But, discuss my grammar.
What should be the penalty for judges, unlawfully overturning rules that dropped crime by 40%, resulting in an increase of murder immediately? What should be done with judges who kill by the hundreds, growing to the thousands?

Andrew: Slight correction. I have not called for the hanging of lawyers. I have called for the arrest, trial, and execution of the treasonous, ruinous, lawyer hierarchy. There will be no $10 mil spent on each case, only $10 for rope. That is about 15,000 people. And, they oppress the lawyer even more than they do the public.
Once this is achieved, the profession will shrink by a half, but your salary will double. The esteem of the public for the profession will also double. You will like yourself twice as much.
